Welcome to Nonaa, a maternal health and support platform operated by Heracules Design & Tech Ltd. These Terms of Use (“Terms”) govern your access to and use of the Nonaa mobile application and services (together, “Nonaa” or “the Platform”).
By creating an account or using Nonaa, you agree to these Terms. If you do not agree, please do not use the Platform.
- Users (Mothers): You must be at least 18 years old to create an account.
- Doctors/Therapists: You must be a licensed healthcare professional and provide accurate credentials during onboarding.
- By registering, you confirm that all information you provide is true and accurate.
Nonaa provides:
- Daily health and wellness check-ins with an AI assistant.
- Social features where mothers can share posts, comment, and connect with others.
- Secure messaging between mothers and their chosen healthcare providers.
- Tools for doctors and therapists to onboard and manage patients.
⚠️ Important: Nonaa does not provide medical care or emergency services. The AI assistant is not a substitute for professional medical advice. Always seek the advice of your doctor for medical concerns.
- You are responsible for keeping your login credentials secure.
- You must not share your account or impersonate someone else.
- You are responsible for all activity under your account.
- Doctors must ensure their professional information remains accurate and up to date.
You agree not to:
- Post or share harmful, offensive, or illegal content.
- Harass, abuse, or threaten other users or doctors.
- Misuse or attempt to gain unauthorized access to the platform.
- Share medical advice if you are not a licensed healthcare professional.
- Use the platform for fraudulent, commercial, or non-health-related purposes without permission.
We reserve the right to suspend or terminate accounts that violate these Terms.
If you are a healthcare provider on Nonaa, you agree to:
- Only engage with patients you have been connected to via the platform.
- Respect patient privacy and comply with all applicable medical and data protection laws.
- Not use Nonaa for emergency consultations.
- Acknowledge that Nonaa is a tool for patient engagement, not a replacement for clinical judgment.
- Your use of Nonaa is also governed by our Privacy Policies (Users, Doctors, AI).
- By using Nonaa, you consent to the collection, use, and sharing of your data as described in those policies.
- We may use anonymized and aggregated data for research, insights, and partnerships — but never in a way that identifies you.
- Access to Nonaa may be subject to subscription fees, which will be clearly communicated before purchase.
- Doctors may receive payments via the platform according to our payout policy.
- All payments are handled securely by third-party payment processors.
- All content, trademarks, and software on Nonaa belong to Heracules Design & Tech Ltd. or its licensors.
- You may not copy, distribute, or reverse-engineer any part of the platform without permission.
- By posting content (e.g., posts, comments), you grant Nonaa a non-exclusive, worldwide license to use, display, and distribute your content within the platform.
- Nonaa is provided “as is” without warranties of any kind.
- We do not guarantee uninterrupted service or error-free performance.
- We are not responsible for any health outcomes based on use of the platform.
To the maximum extent allowed by law:
- Nonaa and Heracules Design & Tech Ltd. are not liable for indirect, incidental, or consequential damages arising from your use of the platform.
- Our total liability to you will not exceed the amount you paid (if any) in the 12 months before the claim.
We may suspend or terminate your account if you:
- Violate these Terms.
- Misuse the platform or endanger other users.
- Provide false information.
- You may stop using Nonaa and delete your account at any time.
We may update these Terms from time to time. If we make significant changes, we will notify you in the app or by email.
These Terms are governed by the laws of Nigeria
- Good Faith Negotiation: If a dispute, claim, or controversy arises out of or relating to your use of Nonaa, you agree to first contact us in writing and attempt to resolve the matter informally within 30 days.
- Mediation and Arbitration (Nigeria): If the dispute cannot be resolved informally, it will be referred to confidential mediation under the Lagos Multi-Door Courthouse (LMDC) rules. If mediation fails, the dispute shall be finally resolved by binding arbitration in accordance with the Arbitration and Mediation Act 2023 (Nigeria). The arbitration shall take place in Lagos, Nigeria, and be conducted in English. The decision of the arbitrator will be final and binding.
- International Expansion: If you are located outside Nigeria, Nonaa may, at its discretion, designate mediation or arbitration under internationally recognized institutions (e.g., the London Court of International Arbitration or International Chamber of Commerce) with proceedings conducted in English.
- No Class Actions: You agree that disputes must be resolved on an individual basis, and not as part of a class, collective, or representative action.
- Court Option: Either party may bring claims related to intellectual property rights, unauthorized use of the platform, or injunctive relief directly in a court of competent jurisdiction without first engaging in arbitration.
Any disputes, claims, or complaints relating to a doctor’s or therapist’s professional conduct, medical negligence, or malpracticeshall not be subject to Nonaa’s dispute resolution process. Such matters must be addressed directly between the patient and the healthcare professional, and, where applicable, referred to the relevant medical regulatory council, licensing authority, or professional disciplinary body in the jurisdiction where the healthcare professional is licensed.
Nonaa is a technology platform and does not assume liability for professional services or medical advice provided by doctors or therapists on the platform.
